These Terms of Service apply to the official website of our company (for information display and client inquiries), covering consultation, quotations, and sales of smart films (PDLC/EC), automotive films, and architectural films. We do not provide installation services; if requested, we may recommend independent third-party installers, but such recommendations do not constitute any warranty, agency, or joint liability. Where these Terms conflict with mandatory laws (e.g., the Australian Consumer Law “ACL”), mandatory laws shall prevail.
1. Definitions
Products: Films and accessories sold by us, including but not limited to OMTD / 3MTD / PDLC smart films, automotive/architectural solar films, heat-insulating/safety films, adhesives, wiring accessories, controllers, and power supplies (if any).
Website: Our official website pages and communication channels are used to publish information and receive inquiries.
Customer/You: Any individual or organization submitting inquiries, requesting information, applying for quotations, or purchasing products via the Website.
Written: Includes emails and electronically signed documents.
Business Days: Monday to Friday, excluding public holidays.
2. Scope
These Terms govern your use of the Website, submission of inquiries, receipt of quotations, and purchase of products. They do not apply to third-party installation or services, and impose no guarantee or obligation on third parties.
3. Acceptance of Terms
By accessing the Website, submitting inquiries, requesting samples/materials, accepting quotations, or placing orders, you agree to be bound by these Terms and referenced documents (such as our Privacy Policy and Return Policy, if applicable). In case of inconsistency, mandatory law or written order/contract terms shall prevail.
4. Updates to Terms
We may update these Terms from time to time and publish them on the Website, effective immediately upon posting. It is your responsibility to review periodically. Continued use of the Website or progression of orders constitutes acceptance of the updates.
5. Customer Eligibility & Authority
You confirm you are legally capable of entering binding contracts. If acting on behalf of an entity, you warrant you are duly authorized and that all information provided is accurate, complete, and current.
6. Website Use, Availability & Prohibited Conduct
6.1 We strive to maintain Website availability and accuracy but make no guarantee of uptime; maintenance, upgrades, or content changes may occur without notice.
6.2 You must not compromise Website security, conduct unauthorized tests (scans, injections, bypassing controls), distribute malicious code, or engage in automated scraping.
6.3 You must not post illegal, infringing, false, misleading, or spam content.
6.4 Security incidents/vulnerabilities should be reported to info@fintint.com; we will review within a reasonable time. If personal data is at risk, we will notify as required by law.
6.5 We implement reasonable technical and organizational measures (TLS encryption, least privilege, audits, backups), but no system is completely secure; you accept inherent risks.
7. Product Information & Technical Disclaimers
7.1 We aim to accurately display product appearance and specifications, but variations between batches, devices, or screens may occur; images are for reference only.
7.2 Optical/energy performance values (VLT, IR, TSER, UV, SC, etc.) vary with glass type, thickness, coatings, environment, and standards. Unless otherwise stated, data is based on standard float glass under lab/manufacturer tests with ±5% tolerance.
7.3 Automotive films: Windshield/side/rear curvature and dot‑matrix areas may cause edge silvering, patterns, or slight unevenness; considered normal.
7.4 Architectural films: Dark/high-reflective films may cause thermal stress. Customers must disclose true glass structures/defects.
7.5 Non-professional disclaimer: Website content is general technical info, not engineering, legal, or compliance advice; consult qualified professionals before decisions.
8. Samples, Color & Real-Life Variation
Samples/color swatches are approximate references. Final effects vary by lighting, substrate, angle, or environment. Minor differences and ΔE≤3–5 color deviations are within tolerance and not defects.
9. Measurement, Cutting & Customization
9.1 Customized orders (cut-to-size/by meter/area) follow measured layouts with tolerance of ±3mm or ±1% (whichever is greater).
9.2 Non-standard/oversized/jointed projects may show visible seams or slight unevenness.
10. Inquiries, Quotations & Contract Formation
10.1 Website prices (if any) are indicative only; valid quotations are issued in writing.
10.2 A contract forms upon your written acceptance of a quotation and satisfaction of payment terms. We may withdraw/correct obvious errors (e.g., pricing/stock).
10.3 Customized orders are non-cancellable; if cancellation is allowed, you bear all material/processing/management/logistics costs incurred.
11. Pricing, Taxes & Currency
11.1 Prices are quoted in the currency stated; confirm inclusion/exclusion of taxes (GST/VAT) before ordering.
11.2 Cross-border duties, import taxes, or clearance fees are borne by the recipient.
12. Payment, Deposits & Retention of Title
12.1 Accepted payment methods are as stated in quotations/invoices (e.g., bank transfer, credit card, third-party payment).
12.2 Custom orders typically require 30%–50% deposit, balance payable before shipment.
12.3 Title remains with us until full payment; risk transfers per Section 14. If overdue, we may suspend production/delivery or terminate.
13. Lead Time, Supply & Alternatives
Delivery times are estimates, subject to supply chain, customs, weather, or logistics. If discontinued/out of stock, we may propose equivalent alternatives subject to your confirmation.
14. Delivery, Risk Transfer & Insurance
14.1 Delivery method/timing as per confirmation.
14.2 Risk transfers upon delivery to carrier or you (whichever first). Insurance is your responsibility.
14.3 Additional costs for failed delivery due to incorrect info/unavailability are your responsibility.
15. Inspection & Defect Notice
Inspect goods within 48 hours of receipt for quantity/appearance. Failure to notify defects within reasonable time = deemed acceptance. Remedies may include repair, replacement, or refund.
16. Cancellation, Returns & Restocking (Non-Defective)
16.1 Customized products (cut-to-size, bespoke, etc.) are non-returnable.
16.2 Non-custom unopened resalable products may be returned within [7/14] days with written approval; you bear round-trip shipping and [10%–20%] restocking fee.
16.3 Refusals, wrong orders, or subjective returns: you bear related costs/risks.
17. Installation & Third-Party Recommendations (Critical)
17.1 We do not provide installation services. Installers we may recommend are independent third parties, not employees, agents, partners, or endorsed by us.
17.2 All matters regarding third-party installation (quotations, quality, timelines, safety, after-sales, disputes) are solely between you and the installer; we assume no warranty or liability.
17.3 We may provide general guidelines but they are not professional advice or guarantees; rely on certified installers/professionals.
18. Automotive Legal Compliance (VLT)
18.1 Regulations for windshield/side/rear films (reflectivity, visible light transmittance “VLT”) differ by jurisdiction. You bear responsibility for compliance in your vehicle’s registration area. We may provide references but not legal advice.
18.2 Any penalties, inspections, or compliance failures are your responsibility.
19. Architectural Thermal Stress & Structural Risks
19.1 Dark/high-reflective films increase thermal stress; risk of cracks in Low‑E, IGU, laminated, tempered, or pre-damaged glass.
19.2 We recommend thermal stress assessment before installation. Customers must disclose accurate glass info. If high risk, redesign or abandon installation is advised.
20. Smart Films / Electrochromics: Electrical & Integration
20.1 Power supplies/controllers/wiring must be installed by licensed electricians, ensuring grounding, moisture protection, surge protection, and safe shutoff.
20.2 Integration with smart home/BMS/access systems must be confirmed; unverified modules may damage products at your risk.
20.3 Failures due to water ingress, circuit tampering, or improper sealing are excluded from warranty.
21. Warranty (Scope, Exclusions & Claims)
21.1 Manufacturer/our limited warranty may cover film defects (e.g., no peeling, bubbling, edge lift, significant fading/oxidation), per warranty card/order.
21.2 Exclusions: normal wear, misuse, improper cleaning/use, unauthorized modifications, glass defects, external impacts, extreme environments, water/surge, electrical faults, out-of-spec use.
21.3 Tolerances: minor batch color variation, haze under strong light, or dot‑matrix/printed area effects are within industry standards.
21.4 Claims: report issues within 7 days with order number, description, photos/videos. Remedies may include repair, replacement, or refund as per law/warranty.
22. Liability Limitation
To the extent permitted by law, we disclaim liability for indirect, incidental, punitive, special, or consequential damages. Direct liability is capped at amounts paid in the 12 months preceding the claim. Consumer rights under mandatory law are not excluded.
23. Intellectual Property & Confidentiality
All Website content/branding is protected by copyright/trademark/design law. Unauthorized reproduction, adaptation, distribution, or competitive use is prohibited. Customer-provided drawings/specs/quotes will be kept confidential except as needed for fulfillment or legal disclosure.
24. Customer Materials & License
You warrant rights to materials provided (drawings, logos, photos, videos, texts) and grant us limited use for quoting, prototyping, production, and after-sales. Materials must not infringe third-party rights.
25. Third-Party Websites, Tools & Tracking (Cookies/Analytics)
25.1 Links to third-party websites/tools are for convenience; we are not responsible for their content, privacy, or transactions.
25.2 We may use cookies, pixels, and analytics (e.g., Google Analytics/Meta Pixel) for improvements/ads. See our Privacy Policy & Cookie Notice for details and opt-out.
25.3 You may manage cookies via browser/settings, but disabling may affect functionality.
26. Privacy, Data & Communication Consent
26.1 Personal data collection, use, sharing, and protection are governed by our Privacy Policy. Minimal required info: name, contact email/phone, company/project.
26.2 Data Retention: We retain inquiry/transaction data for 1 years unless law requires longer.
26.3 Rights: You may request access, correction, or deletion per Privacy Policy, and unsubscribe from marketing.

27. Compliance (Consumer Law, Anti-Corruption, Trade Controls)
27.1 Consumer Law: Nothing excludes your non-waivable statutory rights under ACL or other mandatory laws.
27.2 Anti-Bribery: Neither party shall offer/solicit/accept improper benefits influencing business decisions.
27.3 Export/Sanctions: Cross-border supply may be subject to controls; you must comply.
27.4 Anti-Fraud: We may screen suspicious inquiries/payments and may refuse/terminate if necessary.
28. Accessibility

29. Miscellaneous (Force Majeure, Assignment, Notices, E-Signature, Severability, Entire Agreement, Language)
29.1 Force Majeure: Delays/failures beyond reasonable control (disasters, pandemics, strikes, wars, government acts, supply chain disruption, outages) are excused; affected party shall mitigate.
29.2 Assignment: We may assign/subcontract rights/obligations; you require our written consent to assign.
29.3 Notices: We may notify via email or Website postings; you must keep contact info current and consent to electronic communication.
29.4 E-Signature: Electronic/scan/counterpart signatures are valid.
29.5 Severability/No Waiver: Invalidity of one clause does not affect others; failure to enforce is not waiver.
29.6 Entire Agreement & Language: These Terms + your orders/quotes are the full agreement, superseding prior communication. English version prevails unless law requires otherwise.
